Terms of Service
Last updated: 1 October 2026
These terms govern the use of the FERSoft cloud software (the "Service") provided by Hüseyin Akgül (AKG Bilişim Tasarım Danışmanlık), a sole proprietorship (the "Provider", "we", "us"). The company that subscribes to the Service or uses a trial account (the "Customer") and the users defined by the Customer are deemed to have accepted these terms.
1. Provider
- Company: AKG Bilişim Tasarım Danışmanlık
- Owner: Hüseyin Akgül (sole proprietorship)
- Address: Yeniköy Mahallesi, 41. Sokak, No: 43/A10, Döşemealtı / Antalya, Türkiye
- E-mail: infoakgdb@gmail.com
- Phone: +90 544 333 5208
2. The Service
FERSoft is web-based software (SaaS), used in the browser over the internet, for recipe, costing, stock, production, order and shipment management at fertilizer production plants. The Service includes the right to use the software, hosting, daily backups and updates. No copy of the software is provided to the Customer; all intellectual property rights in the software belong to the Provider. The Customer is granted a non-transferable, non-exclusive right to use the Service for its internal business purposes during the subscription.
3. Accounts and users
- Company accounts are opened by the Provider; the first administrator password is sent to the Customer. The Customer's administrator defines its own users and their permissions.
- The Customer is responsible for the security of user names, passwords and two-step verification devices, and for the actions of its users.
- The user limit of the plan applies to the number of simultaneously active users.
4. Trial period
New companies may be granted a free trial period. No fee is charged during the trial. If no payment is made by the end of the trial, the subscription does not start and the program can only be used for viewing.
5. Fees and payment
- Plan prices are available from the seller on request and are shown on the Settings › Subscription screen of the program. Prices exclude VAT and other taxes. Prices are in US dollars (USD) for Customers outside Türkiye and in Turkish lira (TRY) for Customers in Türkiye.
- Card payments (Customers outside Türkiye): Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. A subscription purchased by card renews automatically at the end of each period from the same card until cancelled; tax is calculated by Paddle based on your country and the invoice is issued by Paddle.
- Card payments (Customers in Türkiye): Payment is collected in TRY through the licensed payment institution iyzico Ödeme Hizmetleri A.Ş., with Turkish VAT added. The subscription renews automatically each period from the same card until cancelled. Card details never reach the Provider. The Provider issues the invoice.
- Bank transfer: Payment is made to the bank account shown in the program, with the company code in the payment description; the Provider issues the invoice. The subscription is extended by the paid period when the payment is received.
- Licence fee: For plans with a licence fee, a Customer who has not previously bought a FERSoft licence pays the programme's licence fee once, in addition to the subscription fee. The licence fee depends on the plan and is shown, excluding taxes, in the Pricing section and on the Settings › Subscription screen of the program. It can be paid by card (through Paddle.com outside Türkiye; through iyzico, with instalment options, in Türkiye) or by bank transfer; a card subscription can be started once the licence fee has been paid. When moving to a plan with a higher licence fee, only the difference is charged; when moving to a lower plan, the difference is not refunded. The licence fee is not refunded if the subscription ends because the Customer cancels it or does not pay; if the Customer subscribes again, the licence fee is not charged again.
- Price changes are announced at least 30 days in advance and apply from the first period starting after the announcement.
6. Unpaid subscriptions
When the paid-until date has passed, a short grace period is granted during which the program works fully. After the grace period the program becomes read-only: data can be viewed, printed and exported, but no new records can be entered. The program returns to normal as soon as payment is received. Accounts that remain unpaid for a long time may be suspended after prior notice. Customer data is not deleted in these cases.
7. Cancellation
The Customer may cancel its subscription at any time. Cancellation takes effect at the end of the paid period, and the program can be used until then. Refund rules are set out in the Refund and Cancellation Policy. The Provider may also terminate the Service in case of a material breach of these terms or with 30 days' notice; in the latter case the fee for the paid but unused period is refunded.
8. Customer data
- All business data entered into the program (recipes, stock, production, orders, customer records, etc.) belongs to the Customer. The Provider processes this data only to provide and back up the Service and for support requested by the Customer; it does not use it for any other purpose and does not share it with third parties.
- Each company's data is kept in a separate database and backed up daily. The Customer can export its data to Excel and download a backup at any time.
- When the subscription ends, the data is handed over to the Customer on request and, upon the Customer's written deletion request, deleted including backups, subject to statutory retention obligations.
- The processing of personal data is described in the Privacy Policy.
9. Acceptable use
The Service may not be used for unlawful purposes, in a way that infringes the rights of others, or in a way that endangers the security of the system or the use of other customers (such as attempts at unauthorised access, excessive load, copying or reverse engineering the software). Accounts used in breach of these rules may be suspended.
10. Availability
The Provider takes reasonable care to keep the Service running securely and without interruption; maintenance and updates are carried out outside working hours where possible. The Provider is not liable for interruptions caused by internet infrastructure, the hosting provider or force majeure.
11. Limitation of liability
The values calculated by the software (recipes, costs, stock, etc.) are based on the data entered by the Customer; checking and using the results is the Customer's responsibility. The Provider's total liability under these terms is limited to the subscription fees paid by the Customer in the 12 months before the damage occurred; no liability is accepted for indirect damages such as loss of profit, consequential damages from data loss or business interruption. Liability for intent and gross negligence and mandatory statutory provisions remain unaffected.
12. Changes
These terms may be updated. Material changes are announced in the program or by e-mail at least 30 days before they take effect. Continued use of the Service after a change means acceptance of the new terms.
13. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Antalya have jurisdiction over disputes. Rights granted to consumers by applicable law remain unaffected.
